# Terms of Service

These Terms of Service ("Terms") govern your use of the Dozzi baby monitor system, including the Dozzi online store and website, the Dozzi mobile application, the Dozzi hardware device, the Dozzi Apple Watch companion app, and all related services (collectively, the "Service"), operated by Dozzi Sleep Systems LLC ("Dozzi," "we," "us," or "our").
By purchasing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

## 1. Eligibility
You must be at least 18 years of age to create an account, make a purchase, and use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
## 2. The Service
Dozzi is a smart baby monitor system that detects infant crying and routes alerts to parents and caregivers. The Service includes:
- The Dozzi online store for purchasing hardware and accessories
- Acoustic cry detection via the Dozzi hub device
- Alert routing between paired parent accounts via the Dozzi App
- Apple Watch integration for biometric-informed smart alert routing
- Multiple alert routing modes (alternating, schedule-based, broadcast, and smart routing)
- Sleep analytics, session history, and milestone tracking
## 3. Important Safety Disclaimer
Dozzi is not a medical device and is not a substitute for responsible parental supervision. The Service is designed as a supplemental tool to assist parents with nighttime cry response coordination. Dozzi does not monitor infant vital signs, breathing, or health conditions. No baby monitor, including Dozzi, can prevent sudden infant death syndrome (SIDS) or other medical emergencies. Always follow safe sleep guidelines from your pediatrician and the American Academy of Pediatrics. You should never rely solely on any baby monitor for your child's safety.
## 4. Account Registration and Security
You are required to create an account to use the Service. You may register using an email address and password or through a supported third-party sign-in provider (Apple Sign-In, Google Sign-In). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
## 5. Online Store and Purchases
### Orders and Payment
All purchases made through the Dozzi online store are subject to product availability and acceptance of your order. We reserve the right to refuse or cancel any order for any reason. Prices are subject to change without notice. Payment must be made at the time of purchase using a valid payment method accepted by our store.
### Shipping and Delivery
Shipping times and costs are displayed at checkout and may vary by location. We are not responsible for delays caused by shipping carriers or customs processing. Risk of loss and title for items purchased pass to you upon delivery to the carrier.
### Returns and Refunds
We offer a 30-day return policy from the date of delivery for unused, undamaged products in their original packaging. To initiate a return, contact us at support@dozzisleep.com. Refunds will be processed to the original payment method within 10 business days of receiving the returned item. Shipping costs are non-refundable unless the return is due to our error or a defective product.
## 6. Device Purchase and Warranty
The Dozzi Device is sold with a limited one-year warranty from the date of purchase covering defects in materials and workmanship under normal use. This warranty does not cover damage caused by misuse, modification, accident, or unauthorized repair. Warranty claims must be submitted by contacting us at the email address below. Our sole obligation under this warranty is to repair or replace the defective device at our discretion.
## 7. Pairing and Shared Access
The Service allows you to pair your account with another parent or caregiver. By pairing accounts, you consent to sharing certain data with your paired partner, including alert preferences, sleep status indicators, and alert routing information. You are responsible for pairing only with individuals you trust. We are not responsible for any disputes arising between paired users.
## 8. Biometric Data and Apple Watch
Certain features of the Service use biometric data (heart rate, heart rate variability, movement) collected through your Apple Watch to inform smart alert routing decisions. By enabling these features, you consent to the collection and processing of this biometric data as described in our [Privacy Policy](https://dozzisleep.com/policies/privacy-policy).
This consent is provided in compliance with applicable state biometric privacy laws, including the Illinois Biometric Information Privacy Act (BIPA) and the Texas Capture or Use of Biometric Identifier Act (CUBI).
You may disable biometric features at any time through your device settings, which will limit the Service to non-biometric alert routing modes. You may revoke your consent to biometric data collection at any time by disabling Apple Watch permissions or contacting us.
**We do not use your health or biometric data for advertising, marketing, or data mining.** Biometric data is used solely to calculate wakeability scores for alert routing as described in our Privacy Policy.
## 9. Health Data and HealthKit
The Dozzi App accesses Apple HealthKit data (heart rate, heart rate variability) with your explicit permission. In accordance with Apple's HealthKit guidelines:
- Health data accessed through HealthKit is used solely for providing core app functionality (smart alert routing)
- Health data is not disclosed to third parties except as necessary to provide the Service (cloud processing via Google Firebase, secure archival via Google Cloud Storage, and — if you opt in to algorithm contribution — anonymized analytics via Google BigQuery as described in our Privacy Policy)
- Health data is not used for advertising or marketing purposes
- You may revoke HealthKit access at any time through your iPhone's Settings > Privacy & Security > Health > Dozzi
## 10. Push Notifications and Critical Alerts
The Service uses push notifications and Apple Critical Alerts to deliver cry notifications. Critical Alerts may bypass Do Not Disturb and silent mode settings on your device to ensure timely notification when your baby needs attention.
- You grant permission for Critical Alerts during app setup
- You may manage notification settings at any time in iOS Settings > Notifications > Dozzi
- Disabling notifications may prevent cry alerts from reaching your devices, which could result in missed alerts
- We are not liable for missed alerts resulting from disabled notifications, network outages, or device settings
## 11. Cloud Services
The Dozzi App relies on cloud services for account management, alert routing, data storage, and push notification delivery. These services include Google Firebase (database, authentication, cloud functions, push notifications), Google Cloud Storage (secure data archival), and Google BigQuery (anonymized analytics for opted-in users). The Service requires an active internet connection to function. We are not responsible for service interruptions caused by third-party cloud provider outages, internet connectivity issues, or scheduled maintenance.
## 12. Firmware Updates
The Dozzi hub device may receive over-the-air (OTA) firmware updates to improve functionality, fix bugs, and address security issues. By using the Service, you consent to the automatic delivery of firmware updates to your hub device. Updates are applied when the hub is idle (not actively monitoring) unless a critical security update is required.
## 13. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the Dozzi Device or App
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service in any manner that could damage or impair it
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service to collect data about other users without their consent
- Resell, redistribute, or sublicense the Service without our prior written consent
## 14. Intellectual Property
The Service, including all software, hardware designs, firmware, and content, is protected by United States patent, copyright, trademark, and other intellectual property laws. Dozzi and its logo are trademarks of Dozzi Sleep Systems LLC. You are granted a limited, non-exclusive, non-transferable license to use the App and Service for personal, non-commercial purposes in accordance with these Terms.
## 15. Subscription and Fees
The Dozzi Device purchase includes access to the core Service features. We reserve the right to introduce premium features or subscription-based services in the future. Any such changes will be communicated to you in advance, and your continued use of paid features will constitute agreement to the applicable fees.
## 16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOZZI SLEEP SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE.
DOZZI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE DOZZI DEVICE.
DOZZI IS NOT LIABLE FOR ANY HARM, INJURY, OR DAMAGE RESULTING FROM:
- RELIANCE ON THE SERVICE AS A SUBSTITUTE FOR DIRECT PARENTAL SUPERVISION
- FAILURE OF CRY DETECTION OR ALERT DELIVERY DUE TO TECHNICAL ISSUES (INCLUDING BUT NOT LIMITED TO WIFI OUTAGES, BLUETOOTH CONNECTIVITY, DEVICE MALFUNCTION, CLOUD SERVICE OUTAGES, OR NOTIFICATION FAILURES)
- DECISIONS MADE BASED ON BIOMETRIC DATA OR ALERT ROUTING
- MISSED ALERTS DUE TO DISABLED NOTIFICATIONS, DO NOT DISTURB SETTINGS, OR DEVICE POWER LOSS
## 17. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT CRY DETECTION WILL IDENTIFY ALL CRYING EVENTS.
## 18. Indemnification
You agree to indemnify and hold harmless Dozzi Sleep Systems LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
## 19. Privacy
Your use of the Service is also governed by our [Privacy Policy](https://dozzisleep.com/policies/privacy-policy), which describes how we collect, use, store, and disclose your personal information, including biometric and health data. By using the Service, you acknowledge that you have read and understand our Privacy Policy.
## 20. FCC Compliance
The Dozzi Device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) this device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation.
## 21. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us or through the App's account deletion feature. Upon termination:
- Your right to use the Service ceases immediately
- Your account data will be deleted in accordance with our Privacy Policy
- Provisions that by their nature should survive (including Limitation of Liability, Disclaimer of Warranties, and Indemnification) will remain in effect
## 22. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
## 23. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and revising the "Last Updated" date. For material changes, we will also notify you through the App or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
## 24. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
